Wrongful death occurs when a negligent, careless, intentional or reckless act of another person or corporation has resulted in the death of a loved one. The effects of this traumatic situation can seem overwhelming and coping with the loss of a loved one is possibly the hardest task to do in this life. While there is nothing you can do to fully compensate the loss of a loved one, in most cases the surviving family members have the right to recover damages for the death. In the very unfortunate case of death, the elements of damages are set forth by statute.

The wrongful death of an adult allows for damages in favor of the spouse, children and the parents of the deceased. The damages include: the loss of financial support that would have been provided by deceased, the grief suffered by the family, the loss of companionship suffered by the family, any physical and mental pain suffered by the deceased prior to death and the medical and burial expenses incurred.

In the death of a minor child, only the parents are entitled to damages. The damages include: medical and burial expenses, loss of anticipated services and support, loss of love and companionship of the child and the destruction of the parent/child relationship. Also recoverable by the parents are monies expended in the support, maintenance and education of the child.

If negligent, careless, intentional or reckless act of another person or corporation results in the death of an individual then in most cases surviving family members have the right to recover for the death.

The amount of recovery can depend upon the amount of money the deceased person was able to earn and whether or not surviving family members were dependent upon this income for support. Other factors to be considered in recovering money can include loss of companionship and loss of love and affection.
